White House backs pharma companies in Supreme Court terror funding case

May 22 (Reuters) -The Biden administration has asked the U.S. Supreme Court to vacate a decision that 21 pharmaceutical and medical equipment companies must face a lawsuit claiming they helped fund terrorism that killed or injured hundreds of American service members in Iraq.
The U.S. Justice Department presented the White House’s views in a filing on Tuesday at the request of the justices. It said a ruling by the Supreme Court in an unrelated case involving Twitter last year undermined the plaintiffs' federal Anti-Terrorism Act claims.
Hundreds of American service members and civilians who said they were harmed in Iraq between 2005 and 2011 filed the lawsuit in Washington, D.C., federal court in 2017.
The defendants, companies owned by AstraZeneca, Pfizer, GE Healthcare USA, Johnson & Johnson and F. Hoffmann-La Roche — allegedly made corrupt payments to the Hezbollah-sponsored militia group Jaysh al-Mahdi in order to obtain medical-supply contracts. The plaintiffs claim Jaysh al-Mahdi controlled Iraq's health ministry.
The case seeks unspecified damages under the Anti-Terrorism Act, which allows Americans to pursue claims related to "an act of international terrorism."
The companies have denied wrongdoing. They asked the Supreme Court to take up the case after the U.S. Court of Appeals for the District of Columbia Circuit last year ruled that the claims could move forward.
The companies in a statement welcomed the Justice Department’s Supreme Court filing.
The Justice Department and a lawyer for the plaintiffs did not immediately respond to requests for comment.
In the Twitter case, the Supreme Court last year shielded the social media company now called X from liability, determining that aiding-and-abetting claims under the Anti-Terrorism Act require showing that a defendant "consciously and culpably" participated in a terror act to help it succeed.
The service members said in a filing to the Supreme Court in August that the plaintiffs suing Twitter had sought to hold it liable for “mere inaction” - the alleged failure to exclude a terror group from the social media platform.
The pharmaceutical and device makers’ “knowing bribes to terrorists were far more culpable,” the service members argued.
The case is AstraZeneca UK Limited et al v. Joshua Atchley et al, U.S. Supreme Court, No. 23-9.
