Philips sues CPAP cleaning product maker, saying it should pay part of settlements

May 13 (Reuters) -Philips PHG.AS has sued SoClean, a maker of ozone-based cleaning systems for breathing devices, in an effort to make it pay part of a $1.1 billion settlement Philips reached last month with people who say they were injured by Philips' recalled devices.
In a complaint filed late Friday in Pittsburgh, Pennsylvania, federal court, the Dutch conglomerate said that if any users were injured after using its machines for treating sleep apnea and other breathing problems, those injuries were caused "in whole or in part" by ozone in SoClean's products.
Philips said that at least 15% of users of the positive airway pressure (PAP) machines covered in the settlement used SoClean products, with the figure likely significantly higher. They may have been injured either by directly inhaling ozone, or because the ozone caused foam in the breathing machines to decay, it said.
The lawsuit also targets DWHP, a healthcare-focused private equity firm that invests in SoClean, saying that SoClean acted as its "alter ego." DWHP and SoClean did not immediately respond to requests for comment.
Philips, which continues to deny that its products injured users, said SoClean and DWHP marketed their cleaning systems specifically as compatible with Philips products. They said that laboratory tests showed that the cleaning systems, which force ozone into the breathing machines, released ozone at a level that exceeds federal limits, and that ozone remains inside breathing machines after cleaning.
Philips has never recommended using SoClean on its devices, instead instructing users to clean them with a mild detergent. The U.S. Food and Drug Administration has issued multiple public statements warning that ozone-based cleaning systems are not approved by the agency or known to be safe.
In November 2023, SoClean revised its manual and provided users with an adaptor intended to keep ozone out of machines. That December, the FDA told consumers in a public statement that it was continuing to work with SoClean to bring it into compliance with agency rules.
Philips claimed in its lawsuit that SoClean had known of the risk for years before it took action in 2023.
Philips recalled the devices in June 2021 over concern that foam used to dampen the machines' sound can degrade and emit toxic gases and small particles, which could irritate patients' airways and potentially cause serious health conditions including cancer. It replaced the foam in recalled devices with silicone.
Claims by people who said they suffered injuries from using the devices, including respiratory illnesses and cancer, were centralized in the Pittsburgh court later that year. Tens of thousands of claims had been lodged with the court by the time of the settlement.
SoClean is also facing lawsuits in the same court. In October it filed a lawsuit accusing Philips of disparaging its cleaners, which remains pending.
